I think you mean intangible or brand value when you say IP right? IP can be anything including &#039;tangible&#039; assets and creative works. Try asking a photographer if what they create is IP or a &#039;tangible creative execution&#039;; it&#039;s actually both.

Perhaps what you meant to say is that those &#039;creative agencies&#039; who focus more on &#039;ideas&#039; and less on that annoyingly challenging business of actually realising those ideas within the complex world of regulations and law (aka &#039;reality&#039;) are susceptible to ridicule for poor judgement. ie they have no idea what they&#039;re doing.</description>

However, the issue agencies now face (and must manage quickly) when they stuff up is dealing with the fallout in a VERY public forum like Mumbrella. There&#039;s a real nastiness that pervades this place. When there&#039;s blood in the water, the sharks outnumber the life jackets 20 to one. That&#039;s life, but agencies which build a reputation on IP, and less on tangible creative/media executions, are the most susceptible to the mob when they are ridiculed for poor judgement.</description>

		<description>Staying compliant as far as electronic messages means you need to follow three specific rules.

1. You must have consent to deliver the message. There is implied and inferred consent, for more information on consent visit ACMA&#039;s consent page (http://www.acma.gov.au/WEB/STANDARD/pc=PC_310572)

2. You must identify the sender of the message. This can be achieved by setting the CallerID to a company name or better you identify yourself within the message itself. You should also qualify the recipient of the message as to why they are receiving the message. eg. Book Club Members. This weeks specials are...

3. You must provide a functional opt-out mechanism. You should be able to reply to any text message to stop receiving from a list. BurstSMS (http://www.burstsms.com) has a free system that allows you to use a shared long code to do this.

For more information on SMS compliance visit the ACMA website (http://www.acma.gov.au/) or the BurstSMS Posterous (http://burst.posterous.com) they have news, and tips on how to stay compliant when sending SMS messages.</description>
