Hungry Jack’s ‘bemused’ by McDonald’s suit: ‘It is clearly evident that customers are not confused’
Hungry Jack’s has hit back at McDonald’s claims that its Big Jack infringes on the trademark of McDonald’s Big Mac.
The fast-food chain released a statement today saying it was ‘bemused’ by the lawsuit and that the two burgers are different in many ways.
“Hungry Jack’s is bemused by the trademark lawsuit filed against it in the Federal Court,” said a spokesperson.
“This is without basis.
“Big Jack is a registered trademark of Hungry Jack’s and it is clearly evident that customers are not confused or misled that the Big Jack and Mega Jack burgers are only available at Hungry Jack’s.”
The spokesperson went on to say the two burgers differ in ‘size, taste, presentation and packaging’. Customers, said Hungry Jack’s, will be able to tell the difference in the 25% more beef on the Big Jack and Megan Jack and the fresh onions.
“Hungry Jack’s burgers are distinctive because of their unique flame grilled taste, quality ingredients and larger size,” said the spokesperson.
“The burgers are better at Hungry Jack’s.”
The core of McDonald’s claim is that the Big Jack and Mega Jack are too similar to the Big Mac in appearance, ingredients and tagline. The suit claims that Hungry Jack’s ‘deliberately adopted or imitated’ the appearance or build of the Big Mac and the famous ad tagline – “two all-beef patties, special sauce, lettuce, cheese, pickles, onions – on a sesame seed bun”.
Hungry Jack’s has chosen to use the ad tagline “two flame-grilled 100% Aussie beef patties, topped with melted cheese, special sauce, fresh lettuce, pickles and onions on a toasted sesame seed bun” in its promotion of the Big Jack. Hungry Jack’s is also running campaigns which make no mention of the inspiration behind the Big Jack.
The Big Jack actually tastes better than Big Mac. Maybe that’s why Maccas is worried?

Considering Burger King in the UK have been selling the exact same burger over the last two decades called The Big King,then I’m not sure how McDonald’s in Australia has a case unless of course they are going for the similar sounding names angle,Big Mac/Big Jack.

The Big Mac has reduced in size, quality and flavor over the years. The Big Jack is so different in all those areas… the Mega Jack is off the hook and a meal on its own. I hope HJ wins this as there is no comparison. Flavor over cardboard.
