Stand-off begins between two Guns For Hire
A legal stoush has begun between two marketing companies with the same name – Guns For Hire.
Perth marketing firm Guns 4 Hire Pty Ltd claims that a new company run by Sydney-based marketing consultant Michael Field Pty Ltd by the same name is causing confusion in the market, and should be changed or dropped.
Field launched Gunsforhire.com in September last year, with a mission to “revolutionise the marketing and advertising industry”.
Guns 4 Hire launched in June 2009.
Guns 4 Hire uses the URL gunsforhiremedia.com.au and gunsforhire.com.au. However, confusingly, Michael Field uses the address gunsforhire.com.
The two companies have now entered legal talks over their respective trademarks.
“Michael doesn’t agree that there’s a conflict of interest here, because he’s in Sydney and I’m in Perth,” Guns 4 Hire director Stephanie Fletcher told Mumbrella.
Field told Mumbrella that he believes he registered the name first, but declined to comment further.

I am the registered owner of the domain name gunsforhire.com which was first registered in 2003.
I am the owner of the business name ‘Guns For Hire’, which was first registered in NSW in 2008.
According to http://www.gunsforhiremedia.com their business was registered in 2009.
When Mumbrella contacted me for this story, I advised them of the above.

Registering a .com domain name means jack from an ip point of view.
Why didn’t you get the .com.au back in 2003?
According to atmoss, the WA guys saw the PR from last September and registered the trademark, which was accepted and has now been opposed.
Find a new name mate, let them have it, they’ve been trading long before you. They also have the com.au, you’re only going to screw your reputation.

We are actually a national company, Guns 4 Hire Pty Ltd. trading under the name Guns for Hire and have done so for 3 years now on a national basis.
You can’t register a .com.au unless your business name is reflective of the domain for australian registrations. We obtained the name easily as well as 4 other names also reflecting our company name.
Unfortunately we have several large Sydney based clients which makes this very confusing in the market.
As per the atmoss, our trade mark was accepted and just short of clearing was opposed.
